Terms and Conditions of Trade

You agree that by engaging Proof Positive to provide services to you, you accept the terms and conditions set out below:

1. Pricing

a. Wherever possible, Proof Positive will detail the expected charges and deposit prior to undertaking work on behalf of a client.

b. The client shall pay all charges made by Proof Positive in the equivalent of US dollars unless the client is in New Zealand, where charges are in New Zealand dollars.

c. All charges are inclusive of any taxes payable by Proof Positive.

In New Zealand prices are quoted exclusive of GST.

d. A deposit is to be paid by the client (at an amount to be advised by
Proof Positive) prior to Proof Positive undertaking any work.

e. The balance of the charges are payable to Proof Positive immediately
following receipt and acceptance of draft and final sign off.

f. All payments shall be made by bank cheque or bank draft.

2. Privacy Policy

Proof Positive respects your privacy and will not collect or retain
information unless it is provided voluntarily for the purposes of emailing
you updates about specific products, special privileges and other items of interest.

Your personal details are required when you engage me for work. Once the work has been completed all information will be destroyed unless requested by the client to be kept on file.

3. Satisfaction Policy

All work is submitted as a draft, subject to amendments by the client. On acceptance of the final draft and sign off by the client, no other
amendments will be accepted and final payment will be due. Any further
amendments required after sign off will require a further price negotiation between the client and Proof Positive.

4. Liability

All due care will be taken by Proof Positive to ensure accuracy and
effectiveness of work, however the final responsibility rests with the
client. To the extent permitted by the laws of New Zealand, Proof Positive accepts no liability on any grounds for consequential damages or losses arising from any cause, including omission or negligence.


5. Applicable Laws

All work is governed by the laws of New Zealand and the Courts of New
Zealand shall have the sole and exclusive jurisdiction to hear and determine all disputes in connection with claims arising from work produced by Proof Positive.
